HOW TO ORGANISE AN ASSEMBLY?

The principle of the EGM

Once a year, the syndic must convene a meeting of co-owners no later than 6 months following the end of the accounting year to vote on the provisional budget .   
 
But there are other cases where the holding of a general meeting is necessary in a condominium. 
 
The syndic can organize a GA as soon as he deems it useful, we call it EGM (Extraordinary General Assembly), this assembly allows to respond to an urgent and major concern. 

For example, work is necessary when an event clearly disturbs the tranquility of the condominium. 
But also, within 15 days of a natural disaster damaging the common areas.
Here, the objective of the organization of the general assembly is to decide on the work to renovate the common areas. 

The EGM convened by the SC or a co-owner

The organisation of the general assembly may be decided by the trade union council.

The co-owners can also call for this meeting: the co-owner or co-owners must represent at least 1/4 of the votes.
It is therefore in small condominiums that a co-owner can, on his own, convene a general meeting. For larger condominiums  , more members are needed. 

This request for a meeting must be made to the syndic by registered mail with acknowledgment of receipt.
Then, the syndic will have to convene the co-owners.
The law provides that the latter must organize the GA within 8 days.

No return from the trustee?

In this case, several persons may convene the EGM:
  • The President of the Union Council (PCS),
  • The co-owners (if no CS, no trustee or no general assembly organized),
  • The town hall,
  • The President of the EPCI.

Except in an emergency, theconvocation must be made 21 days before the date of the GA, by registered letter with acknowledgment of receipt (LRAR) or electronically (LRE) if prior written agreement of the co-owner(s).
Hand delivery against signature or receipt remains the most economical solution. 

Attention : This period runs from the first presentation of the letter to the co-owner, moreover if the RCP provides for a longer period, it is this period that must be applied.

In short

The Extraordinary General Meeting (EGM) may be held at any time, as long as it complies with the terms of convocation.

Its purpose is to deal with matters other than those of an ordinary general meeting (AGM).

However, if the situation requires it, it may also deal with the day-to-day management of the condominium.

Any interested person can (under certain conditions) organize an EGM.
