What is a professional trustee?


The professional syndic is a legal person that practices in its own name or within a partnership. It must meet the following conditions in order to be able to carry out its mission :
  • Justify a sufficient financial guarantee to ensure the repayment of the co-ownership of its funds in the event of bankruptcy ;
  • Proof of professional liability insurance;
  • Possess a professional card bearing the mention syndic of co-ownership, issued by the Chamber of Commerce and Industry.

Missions

The professional syndic manages the co-ownership and finances. It is linked to a syndicate of co-owners by a fixed-term contract (CDD). He acts in his own name and on behalf of the syndicate, he collects royalties on its behalf, he enters into contracts for the maintenance and conservation of the building.
The professional trustee receives a fee for his activity while the non-professional trustee may be a volunteer.

Designation

The appointment of the trustee is different depending on whether the co-ownership already exists or is newly created.
  • Existing condominium
The selected syndicate must be appointed by the GA during a vote of the co-owners by an absolute majority.
  • New condominium
A provisional trustee must be designated by the co-ownership regulations. Its mission is to convene the first GA that will appoint the syndic.

Term of office

The term of office of the trustee must be provided for by a vote in the General Assembly. The term of office is renewable and is only valid for a maximum of 3 years. If there is renewal, this decision must be voted in GA by an absolute majority.
